1. Acceptance

By downloading Clock Us In (an app offered by Commanda Pay Inc) or using clockusin.com you agree to these Terms.

2. Definitions

• "App" means the Clock Us In iOS application.
• "Service" means the App and website together.
• "Manager" means the business owner or designated staff member using the app in Manager mode.
• "Employee" means a staff member using the app in Employee mode.

3. Service description

Clock Us In is a local staff time-tracking tool offered by Commanda Pay Inc for restaurants and small business operators. All employee, shift, and schedule data is stored on the Manager’s device. We do not provide a cloud payroll platform, payment processing, or point-of-sale system.

4. Eligibility

You must be 18 or older and authorised to manage staff on behalf of the business.

5. Employee data responsibility

The Manager is responsible for obtaining any consent required under applicable law before recording employee shift data within the App. Commanda Pay Inc is not the data controller for employee records entered into the App — the business operator is.

6. Data accuracy

The Manager is responsible for the accuracy of all shift times, break records, and employee information entered into or confirmed within the App. Clock Us In timesheet adjustments are suggestions based on App records; they do not constitute legal payroll records without independent verification.

7. Mobile app downloads

The App is distributed via the Apple App Store. Apple’s terms apply to download and installation.

8. Acceptable use

Do not use Clock Us In to record shifts for staff who have not consented to time tracking, or for any unlawful purpose.

9. Intellectual property

All App code, design, and content are owned by Commanda Pay Inc. You receive a limited, non-exclusive licence to use the App.

10. Support & availability

We aim to respond to support requests within 1 business day. We do not guarantee uninterrupted availability of the App.

11. Third-party services

The App uses Apple’s camera framework for QR scanning and CoreLocation for Wi-Fi network name detection. The website uses HubSpot and Google reCAPTCHA. Their respective terms apply.

12. Disclaimer

The App is provided "as is." Timesheet records are generated from device clock-ins and any manual adjustments made by the Manager. We make no warranties that records will satisfy any specific legal or payroll compliance requirement.

13. Limitation of liability

To the maximum extent permitted by law, Commanda Pay Inc is not liable for any indirect, incidental, or consequential damages arising from use of the App, including but not limited to payroll disputes, wage-hour compliance issues, or data loss due to device failure.

14. Indemnification

You agree to indemnify Commanda Pay Inc against claims arising from your misuse of the Service, including any claims by employees related to inaccurate time records.

15. Privacy

Use of the App and website is also governed by our Privacy Policy at clockusin.com/privacy-policy.

16. Governing law

17. Changes

We may update these Terms. Continued use constitutes acceptance of the updated Terms.
